Welcome to pkimma.com (the “Website”), operated by Professional Karate Institute Mixed Martial Arts (“PKIMMA”), a Texas limited liability company (“Company,” “we,” “our,” or “us”).
By accessing this Website or purchasing any services, you agree to be bound by the following Terms and Conditions. If you do not agree, please do not use this Website.
1. Services
PKIMMA provides martial arts instruction and related programs at its physical training facility. Through this Website, customers may purchase:
- Class passes
- Event registrations
- Promotional training packages
- Camps, seminars, or workshops
- Other in-person training services
All services purchased online are delivered in person at our physical location.
2. Legal Entity
Professional Karate Institute Mixed Martial Arts (“PKIMMA”) is a registered “doing business as” (DBA) of Professional Martial Arts Institute, LLC, a Texas limited liability company.
PKIMMA locations may be independently owned and operated. Each individual PKIMMA location is solely responsible for its own operations, instructors, staff, contracts, pricing, promotions, policies, and customer relationships.
Unless otherwise expressly stated in writing, enrollment, purchases, and participation in services are made with and provided by the specific PKIMMA location where services are rendered. That location assumes responsibility for the delivery of services and related liabilities.
Nothing in these Terms shall be interpreted as creating a partnership, joint venture, or agency relationship between independently owned PKIMMA locations.
3. Eligibility
By purchasing services:
- You represent that you are at least 18 years old, or
- You are the parent or legal guardian of a minor participant.
Parents/guardians assume full financial and legal responsibility for minors enrolled in our programs.
4. Payments and Pricing
All prices are listed in U.S. Dollars.
Payment is required at the time of purchase.
We reserve the right to modify pricing or discontinue promotions at any time.
Charges will appear under PKIMMA, Professional Martial Arts Institute, LLC or a related merchant descriptor.
5. Refund & Cancellation Policy
Unless otherwise expressly stated:
- Class passes and event registrations are non-refundable.
- Missed classes are not refundable.
- Transfers to another participant may be permitted with prior written approval.
- If the Company cancels an event or class, we may offer a reschedule, credit, or refund at our discretion.
No cash value is assigned to unused sessions.
6. Expiration of Services
Certain passes or promotional packages may include expiration dates. Expiration terms will be disclosed at the time of purchase. Expired services will not be refunded or extended unless otherwise agreed in writing.
7. Assumption of Risk
Martial arts training involves physical activity and inherent risks, including but not limited to:
- Sprains, strains, bruises
- Broken bones
- Concussions
- Serious bodily injury
By enrolling in classes or events, you acknowledge and voluntarily assume all risks associated with participation.
A separate Waiver and Release of Liability may be required prior to participation.
8. Medical Representation
Participants represent that they (or their minor child):
- Are physically fit to participate
- Have no medical condition that would prevent safe participation
It is your responsibility to consult a physician prior to participation if needed.
9. Conduct & Right to Refuse Service
We reserve the right to refuse service or remove any participant for:
- Disruptive behavior
- Unsafe conduct
- Failure to follow instruction
- Harassment or inappropriate behavior
Removal due to misconduct does not entitle the participant to a refund.
10. Website Use
You agree not to:
- Use the Website for unlawful purposes
- Attempt to access restricted systems
- Copy, distribute, or exploit Website content without permission
All Website content is owned by Professional Martial Arts Institute, LLC and protected under applicable intellectual property laws.
11. SMS Terms
- You can cancel the SMS service at any time. Just text “STOP” to 210-690-5300. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
- If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at inquiries@pkimma.com.
- Carriers are not liable for delayed or undelivered messages
- As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive 4-6 messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
- If you have any questions regarding privacy, please read our privacy policy.
12. Limitation of Liability
To the fullest extent permitted by Texas law, Professional Martial Arts Institute, LLC and its instructors, employees, and affiliates shall not be liable for:
- Indirect or consequential damages
- Loss of profits
- Injuries sustained during participation, subject to signed waiver agreements
Participation is voluntary and at your own risk.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas. Any disputes shall be resolved in the appropriate courts located in Texas.
14. Modifications
We reserve the right to update these Terms at any time. Continued use of the Website constitutes acceptance of any revisions.
